Terms of Service

The general terms governing website use, consultations, proposals, and KAELIX project services.

Effective date: July 13, 2026

Acceptance

By using this website, booking a consultation, submitting an inquiry, accepting a proposal, signing an agreement, or purchasing services, you agree to these Terms and the Privacy Policy.

A consultation request does not guarantee that KAELIX will accept a project.

Project Agreements

Paid projects should be governed by a written proposal, statement of work, or project agreement defining the scope, deliverables, price, payment schedule, revisions, and estimated timeline.

A signed project-specific agreement controls if it directly conflicts with these general Terms.

Estimates and Timelines

Quotes, schedules, milestones, and completion dates are good-faith estimates based on the information available when provided unless expressly guaranteed in writing.

  • Client delays, late approvals, missing content, expanded scope, technical discoveries, and third-party service failures may extend the schedule.
  • KAELIX will communicate material timeline changes when reasonably possible.

Scope and Additional Work

The project scope is limited to the deliverables listed in the applicable agreement.

New pages, features, integrations, redesigns, content services, or other work outside the approved scope may require a written change order, additional fees, and a revised schedule.

Client Responsibilities

Delays caused by missing materials, approvals, access, or feedback may extend deadlines and may require rescheduling.

  • Provide accurate project information and timely feedback.
  • Supply required text, images, branding, credentials, and approvals.
  • Confirm that supplied materials may legally be used.
  • Review deliverables and report problems within the agreed review period.
  • Maintain backups, credentials, licenses, and accounts assigned to the client after delivery.

Third-Party Services

Projects may rely on hosting providers, domain registrars, payment processors, email providers, APIs, plugins, fonts, libraries, and other third-party services.

KAELIX is not responsible for third-party outages, policy changes, price changes, account suspensions, security incidents, discontinued features, or actions outside KAELIX's reasonable control.

Warranty and Liability

KAELIX will use reasonable professional care to deliver work that substantially matches the approved project scope at delivery.

KAELIX does not guarantee uninterrupted operation, search rankings, sales, revenue, traffic, platform approval, or business outcomes.

To the extent permitted by law, KAELIX's total liability relating to a project is limited to the amount paid to KAELIX for the affected services. KAELIX is not liable for indirect, incidental, special, punitive, or consequential damages.

Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Unless otherwise agreed in writing, disputes must be brought in a court with appropriate jurisdiction in Alabama.
